What does this mean to you?
The Presumption of innocence means that the Government is required to prove each element of the crime they allege against you beyond a reasonable doubt. Until this occurs, you must be considered 100% innocent.
It means that once the Government has arrested you and charged you with a crime,
it has to build a case against you that is so strong that no reasonable doubt can exist regarding your guilt. Your rights during the investigation and prosecution of your case must not be violated.
As Defense Counsel, one of our primary duties to you is to protect your rights and exclude the evidence against you if your rights are violated. We will thoroughly investigate your case, and establish a reasonable doubt, if at all possible.
Often the District Attorney files charges they cannot prove, or turns a blind eye to law enforcements' violation of your rights.
